23 October 2026The Over the Counter Derivatives (Intragroup Transactions) Regulations 2026 have been laid before Parliament and published, alongside an explanatory memorandum. The Regulations, made on 21 October, aim to replace the temporary intragroup exemption regime, which expires on 31 December, with a permanent framework for intragroup exemptions from clearing and margin requirements under the UK European Market Infrastructure Regulation. The draft version of the Regulations was published in July. For more detail on the provisions, please see our blogpost titled “Draft Over the Counter Derivatives (Intragroup Transactions) Regulations 2026 published”. The Regulations will come into force when the revocation of the existing transitional provisions as set out in Part 5 of the Over the Counter Derivatives, Central Counterparties and Trade Repositories (Amendment, etc., and Transitional Provision) (EU Exit) Regulations 2019 comes into force.
